1. Introduction
Welcome to Wered Co. These Terms of Use and Conditions ("Terms") govern your use of our services and establish the agreement between Wered Co. ("we," "us," "our") and our clients ("you," "your"). By using our services, you agree to comply with these Terms. If you do not agree, please do not use our services.
2. Services Provided
Wered Co. offers a one-time service, which includes:
- App development using Flutter & Dart Components
- iOS and Android listing creation & upload
- App design
- Support for iOS Developer Program enrollment (cost not included)
- Support for Android Developer Account (cost not included)
3. Payment Terms
- Payment Process: Clients pay a one-time fee for the service through Mercado Pago, a secure payment platform.
- Additional Costs: Clients are responsible for the costs of enrolling in the iOS Developer Program and creating an Android Developer Account.
- Refund Policy: Refunds are not provided once the service has commenced.
4. Service Delivery
After accepting these Terms and providing necessary shop information, the app will be created and uploaded within 7 business days.
5. Client Responsibilities
- Maintain E-Commerce Website: Clients must maintain their e-commerce website to ensure the app functions properly.
- Adhere to Platform Terms: Clients must comply with the terms and policies of their e-commerce platform (e.g., TiendaNube, Square Online Shops).
6. Intellectual Property
- Client Ownership: Clients own their content, the code and designs of the app solution.
- Platform Rights: The e-commerce platform (e.g., TiendaNube, Square Online Shops) owns the rights to the website code.
7. Integration with E-Commerce Platforms
As Wered Co. displays all TiendaNube features, all integrations that work on TiendaNube will be available to use in the app.
8. Client Support
Wered Co. offers email support at info@weredco.com during business hours.
9. Limitation of Liability
Wered Co. is not responsible if TiendaNube or the e-commerce platform starts conflicting with Flutter WebView.
10. Dispute Resolution
Any disputes arising out of or relating to these Terms or the services provided by Wered Co. shall be resolved through binding arbitration in accordance with the rules of a chosen arbitration organization. Before resorting to arbitration, the parties agree to attempt to resolve any dispute through mediation. Each party shall bear its own costs and expenses, including attorneys' fees, and shall share equally the mediator's and arbitrator's fees and expenses.
11. Indemnification
Clients will indemnify Wered Co. against claims arising from their use of the service or any breach of terms.
12. Modifications to Terms
Wered Co. reserves the right to modify these Terms at any time. Clients will be informed about changes via email.
